1. PARTIES This Agreement has been signed between the following parties under the terms and conditions stated below. No:9 Merkez/Afyonkarahisar, Türkiye By accepting this agreement, the BUYER acknowledges that if they approve the order, they will be under the obligation to pay the order price and any additional fees such as shipping costs and taxes, and that they have been informed of this in advance. 2. DEFINITIONS In the implementation and interpretation of this agreement: MINISTRY: The Ministry of Customs and Trade of the Republic of Türkiye. LAW: The Law on the Protection of the Consumer No. 6502. REGULATION: The Regulation on Distance Contracts. GOODS/PRODUCT: Any type of movable property subject to shopping (Marble, natural stone, aerospace components, etc.). SITE: The official website of the SELLER, www.marblecenter.com.tr. 3. SUBJECT This Agreement regulates the rights and obligations of the parties in accordance with Law No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of the product ordered by the BUYER electronically through the SELLER's website. 4. SELLER AND ORDER INFORMATION The type, quantity, brand, model, and total sales price including all taxes of the products are as specified on the order confirmation page and in the invoice issued during delivery. 5. GENERAL PROVISIONS 5.1. Preliminary Information: The BUYER declares that they have read the preliminary information regarding the basic characteristics, sales price, payment method, and delivery conditions of the product on the Site and have given the necessary confirmation in the electronic environment. 5.2. Delivery Period: The product shall be delivered within a period not exceeding the legal limit of 30 days from the date of the order, depending on the distance of the BUYER's residence. 5.3. Quality Assurance: The SELLER is responsible for delivering the product subject to the contract in a sound, complete manner, in accordance with the specifications specified in the order, and with warranty documents and user manuals, if any. 5.4. Force Majeure: If the SELLER cannot deliver the product within the required time due to force majeure events (extraordinary circumstances) beyond the control of the parties, the SELLER is obliged to notify the BUYER of the situation. 6. RIGHT OF WITHDRAWAL 6.1. The BUYER may exercise the right to withdraw from the contract by rejecting the goods within 14 (fourteen) days from the date of delivery to themselves or the person/organization at the address indicated, without assuming any legal or criminal liability and without giving any justification. 6.2. To exercise the right of withdrawal, written notification must be made to the SELLER by registered mail, fax, or e-mail within this 14-day period. The product must be unused and in its original packaging. 6.3. Refund Policy: Within 14 days following the receipt of the withdrawal notification, the SELLER is obliged to refund the total price to the BUYER. 7. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED The right of withdrawal cannot be exercised in the following cases: Products prepared specifically according to the BUYER's requests or personal needs (e.g., marble or stones cut according to custom dimensions). Goods that are liable to deteriorate rapidly or have the potential to expire. Digital content or software whose protective elements (packaging) have been opened. 8. STATE OF DEFAULT AND LEGAL CONSEQUENCES The BUYER accepts, declares, and undertakes that if they fall into default in transactions made by credit card, they will pay interest within the framework of the credit card agreement between the cardholder bank and themselves and will be liable to the bank. 9. GOVERNING LAW AND JURISDICTION This Agreement is subject to the laws of the Republic of Türkiye. In disputes arising from the Agreement, Consumer Arbitration Committees or Consumer Courts in the place where the BUYER resides or where the consumer transaction is made are authorized up to the value declared by the Ministry. In international commercial transactions, the parties accept the jurisdiction of the International Trade Courts and, where applicable, the ICC arbitration standards. 10. ENFORCEMENT When the BUYER completes the payment through the Site, they are deemed to have accepted all the terms of this agreement.
